Welcome to fireship.ai! Before you access our services, please read these Terms of Service.

These Terms of Service ("Terms") govern your use of fireship.ai services, including any associated apps, software, and websites (collectively, our "Services"). These Terms form a contract between you and fireship.ai, PBC (excluding our Providers), and include our Acceptable Use Policy. By accessing our Services, you agree to these Terms.

Please read our Privacy Policy, which describes how we collect and use personal information.

Note: Our Commercial Terms of Service govern your use of any fireship.ai API key, the fireship.ai Console, or any other offerings that reference the Commercial Terms of Service. This does not include individual or entity use of the Services.

1. Who We Are

fireship.ai is a company focused on AI safety and research, dedicated to building reliable, interpretable, and steerable AI systems. We conduct cutting-edge research, develop various safety techniques, and deploy these systems through partnerships and products.

2. Account Creation and Access

Minimum Age: You must be at least 18 years old or the minimum age required by your location, whichever is higher.
Your Account: You are required to provide accurate, current, and complete information when creating an account. We use this information to communicate with you about our Services. You must not share your login information or account access.
Business Domains: If your email belongs to an employer or organization, your account may be linked to that enterprise account with possible monitoring and control by the organization's administrator.
Evaluation Services: We may offer limited-time evaluations of our Services for personal, non-commercial use.
Additional Terms: Some services may require acceptance of additional terms, altering your rights or obligations, including payment.

3. Use of Our Services

You are authorized to use our Services only in accordance with these Terms, our Acceptable Use Policy, and any posted guidelines or terms. Prohibited uses include, but are not limited to, violating laws, developing competing products, unauthorized data harvesting, and disrupting or damaging our Services or users.

4. Prompts, Outputs, and Materials

Responsibility: You are responsible for the content of your prompts and must ensure you have all necessary rights.
Outputs: Outputs from our Services may not always be accurate and should not be relied upon without independent verification.
Use of Materials: We may use materials you provide to improve our Services and develop new products, under certain conditions.

Billing: We will bill you using the provided payment method for recurring or usage-based fees.
Subscriptions: Subscriptions automatically renew unless cancelled. Details about subscription content, fees, and cancellations are outlined in our processes.

Our Services may integrate with third-party content, which is not under our control. You use such services at your own risk.

8. Software

We may update our software without prior notice. Conflicts between these Terms and other terms will default to the controlling terms specified in those agreements.

9. Ownership of the Services

The Services are owned and operated by fireship.ai and its affiliates. Use of our services grants no additional rights or ownership to users.

10. Disclaimer of Warranties and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. fireship.ai is not liable for any damages arising from your use of the Services. Our total liability will not exceed the greater of the amount paid by you over the last six months or $100.

11. General Terms

Changes to Services: We reserve the right to modify or discontinue the Services at any time.
Termination: We may terminate your access to the Services for breach of these Terms or other outlined reasons.
Severability and Waivers: Our failure to enforce any part of these Terms is not a waiver of our right to later enforce that or any other part of these Terms.

12. Governing Law and Dispute Resolution

Disputes will be governed by the laws of California and resolved in the courts of San Francisco. You waive any objection to this jurisdiction and venue.
